These Terms of Service (“Terms”) govern access to and use of the websites, dashboards, applications, integrations, data-processing systems, and related services operated by Pathfinder Oncology (“Pathfinder Oncology,” “we,” “us,” or “our”), collectively referred to as the “Services.”
By accessing or using the Services, you agree to comply with these Terms. If you do not agree with these Terms, you must not access or use the Services.
- Purpose of the Services
The Services are primarily intended to support authorized Pathfinder Oncology activities, including:
- Internal data processing;
- Operational analysis;
- Reporting and analytics;
- Dashboard creation and visualization;
- Project and client support;
- Administrative workflows;
- Quality-improvement activities;
- Research-support activities; and
- Other approved organizational purposes.
The Services may receive and process information through authorized third-party integrations, including the Guava API.
Unless expressly stated otherwise, the Services are not intended for unrestricted public use.
- Authorized Users
Access to the Services may be limited to authorized Pathfinder Oncology employees, contractors, consultants, clients, partners, service providers, or other approved individuals.
Users are responsible for:
- Accessing the Services only when authorized;
- Using the Services only for approved business purposes;
- Protecting usernames, passwords, authentication credentials, and access links;
- Not sharing credentials with unauthorized individuals;
- Following applicable privacy, security, confidentiality, and data-use requirements; and
- Promptly reporting suspected unauthorized access, loss of information, or security incidents.
Pathfinder Oncology may restrict, suspend, or terminate access when access is no longer required or when continued access may create a legal, privacy, security, or operational risk.
- Guava API Integration
The Services may receive health and related information through the Guava API when an individual or organization has authorized the applicable connection or transfer.
Depending on the permissions granted, the information received through Guava may include medical records, laboratory results, medications, conditions, clinical documents, health measurements, demographic information, account identifiers, and other related information.
Pathfinder Oncology will access information through Guava only within the permissions and authorizations provided through the applicable account, integration, agreement, or consent process.
Connecting a Guava account or authorizing a data transfer does not grant Pathfinder Oncology ownership of the underlying information.
- Permitted Use
The Services are intended only for authorized Pathfinder Oncology activities, including internal data processing, operational analysis, reporting, dashboard visualization, project support, and other approved organizational purposes.
Authorized users may access and use information available through the Services only:
- For the specific purpose for which access was granted;
- Within the scope of their assigned role and permissions;
- In accordance with applicable confidentiality, privacy, security, and data-use requirements;
- In accordance with applicable agreements, consents, and authorizations; and
- As permitted by applicable law.
Users may not access, use, download, disclose, distribute, copy, retain, or transfer information for:
- Personal purposes;
- Unauthorized research;
- Advertising or marketing;
- Profiling unrelated to the authorized purpose;
- Sale or commercial resale;
- Activities outside the user’s approved responsibilities; or
- Any unlawful or unauthorized purpose.
Access to information through Guava or another connected service does not give a user permission to use that information outside the authorized business purpose.
- Prohibited Conduct
Users may not:
- Attempt to access accounts, systems, or information without authorization;
- Bypass authentication, access controls, or security measures;
- Share confidential or sensitive information with unauthorized individuals;
- Introduce malware, harmful code, or disruptive technology;
- Interfere with the availability or operation of the Services;
- Attempt to reverse engineer or improperly extract protected components of the Services;
- Use automated tools to access the Services without authorization;
- Misrepresent identity, authority, or organizational affiliation;
- Use the Services to violate privacy, intellectual-property, confidentiality, contractual, or legal rights; or
- Use information obtained through the Services for an unauthorized purpose.
- Confidentiality
The Services may contain confidential, proprietary, personal, health-related, operational, research-related, or commercially sensitive information.
Users must protect this information and may use or disclose it only as permitted by:
- Their role and assigned responsibilities;
- Applicable policies and procedures;
- Applicable contracts and data-use agreements;
- Applicable patient, user, or organizational authorization; and
- Applicable law.
Confidentiality obligations continue after a user’s access to the Services ends.
- Health Information
Some information processed through the Services may be sensitive health information.
Pathfinder Oncology will process such information only for authorized purposes and subject to applicable access controls, agreements, policies, authorizations, and legal requirements.
Where applicable, the handling of health information may also be governed by separate agreements, including business associate agreements, data-use agreements, client agreements, research agreements, or patient authorizations.
These Terms do not replace any separate agreement that applies to the information or Services.
- No Medical Advice
The Services, including dashboards, reports, analytics, summaries, and visualizations, are intended for operational, administrative, analytical, reporting, research-support, or informational purposes.
Unless expressly stated otherwise, the Services do not provide medical advice, diagnosis, treatment recommendations, or emergency medical services.
Information displayed through the Services should not replace professional clinical judgment or advice from a qualified healthcare provider.
Users are responsible for independently reviewing and validating information before relying on it for clinical or other significant decisions.
- Data Accuracy
Information available through the Services may originate from Guava, healthcare systems, users, clients, third-party platforms, or other external sources.
Pathfinder Oncology does not guarantee that all information received from third-party sources will be complete, current, accurate, or error-free.
Users should verify important information through the appropriate original source before relying on it.
- Third-Party Services
The Services may integrate with or rely on third-party platforms, APIs, databases, hosting providers, software applications, or data providers, including Guava.
Third-party services are governed by their own terms, privacy policies, technical limitations, and availability.
Pathfinder Oncology does not control and is not responsible for the independent practices, availability, security, content, accuracy, or performance of third-party services.
We may modify, replace, restrict, or discontinue an integration when reasonably necessary.
- Intellectual Property
The Services, including their software, interfaces, dashboards, designs, documentation, reports, visualizations, workflows, and related materials, are owned by or licensed to Pathfinder Oncology unless otherwise stated.
These Terms do not transfer ownership of Pathfinder Oncology intellectual property to any user.
Information supplied by users, clients, patients, healthcare organizations, partners, Guava, or other third-party systems remains subject to applicable ownership rights, licenses, permissions, agreements, and restrictions.
- Service Availability
Pathfinder Oncology may update, modify, suspend, restrict, or discontinue any part of the Services at any time.
Although we seek to maintain reliable and secure Services, we do not guarantee that the Services will always be:
- Available;
- Uninterrupted;
- Error-free;
- Complete;
- Accurate;
- Secure; or
- Compatible with every device, system, or third-party service.
Maintenance, technical issues, security concerns, third-party outages, or changes to external APIs may affect availability.
- Security
Users must follow all applicable security requirements when accessing the Services.
Users must not store, download, transmit, or share sensitive information through unapproved systems or methods.
Pathfinder Oncology may monitor access, maintain audit logs, review system activity, and investigate suspected misuse or security incidents where permitted by law and applicable agreements.
- Suspension and Termination
Pathfinder Oncology may suspend or terminate access when:
- Authorization ends;
- A user’s employment, contractual, client, or partnership relationship ends;
- Access is no longer required;
- These Terms or an applicable policy are violated;
- Access creates a security, privacy, legal, or operational concern;
- A connected account or integration is disconnected; or
- The Services are discontinued.
Following termination, provisions concerning confidentiality, intellectual property, limitations of liability, disclaimers, and other obligations intended to survive termination will remain effective.
- Disclaimer of Warranties
To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis.
Pathfinder Oncology disclaims all express, implied, and statutory warranties, including warranties of:
- Merchantability;
- Fitness for a particular purpose;
- Accuracy;
- Availability;
- Non-infringement;
- Reliability; and
- Security.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
- Limitation of Liability
To the fullest extent permitted by law, Pathfinder Oncology and its officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Services.
This includes damages related to:
- Loss or corruption of data;
- Loss of access;
- Business interruption;
- Reliance on incomplete or inaccurate information;
- Third-party service failures;
- Unauthorized access;
- Integration errors; or
- Decisions made using dashboard information.
Some jurisdictions do not permit certain limitations of liability, so parts of this section may not apply in every circumstance.
- Changes to These Terms
Pathfinder Oncology may update these Terms periodically to reflect changes in the Services, integrations, business practices, or legal requirements.
Updated Terms will be posted on this page with a revised “Last Updated” date.
Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms where permitted by law.
